A Reform UK councillor has been charged after allegedly posting a grossly offensive comment about Nigerians on social media, more than two years after the controversial message first appeared online.

Glenn Gibbins, who serves as a councillor in Sunderland, is facing legal action over a Facebook post made in March 2024 in which he suggested that Nigerians should be “melted down” to fill potholes.

The case has reignited debate in the United Kingdom over hate speech, online conduct by elected officials, and the legal consequences of offensive social media posts.

“Can’t believe amount of Nigerians in town… should melt them all down and fill in the pot holes.”

The comment sparked widespread condemnation after resurfacing following his election earlier this year.

Under UK law, offensive online communications may be prosecuted under the Communications Act 2003, depending on the nature and context of the message. More information about the legislation is available on the official UK legislation website: https://www.legislation.gov.uk/ukpga/2003/21/contents.

Police confirm criminal charge

On Wednesday, July 29, 2026, Politics UK reported via its official X account that Northumbria Police had formally charged Gibbins over the post.

The report stated that the councillor had been charged with publishing a grossly offensive message under the Communications Act 2003.

According to the police, Gibbins is scheduled to appear before South Tyneside Magistrates’ Court on August 21, 2026, where the matter will be heard.

Authorities have not released additional details regarding the prosecution beyond confirming the charge.

Reform UK previously suspended him

The controversy dates back to shortly after Gibbins was elected during the May 2026 local elections.

Following public backlash over the resurfaced Facebook post, Reform UK suspended him pending an internal disciplinary investigation.

However, the suspension proved temporary.

In June, the party reinstated Gibbins after he apologised for the remark and received what it described as a final written warning.

According to Reform UK, Gibbins admitted that the post demonstrated poor judgment.

The party stated:

“He apologised for making the post and accepts that it was made in extremely poor taste showing poor judgement.”

Despite the apology, criminal proceedings have now moved forward independently of the party’s disciplinary process.

Court appearance scheduled

Northumbria Police confirmed that Gibbins will appear before South Tyneside Magistrates’ Court next month.

If convicted, the court will determine the appropriate penalty under the Communications Act.

The law makes it an offence to send electronic communications that are considered grossly offensive, indecent, obscene or menacing in certain circumstances.

Legal experts note that each case is assessed individually, taking into account the content of the message, the surrounding context and applicable legal standards.

Reform UK monitoring proceedings

Following confirmation of the criminal charge, Reform UK issued a brief statement saying it would monitor the legal process.

A party spokesperson said:

“The party is aware of the situation involving Cllr Gibbins. We will monitor the verdict closely.”

The party has not announced whether any further disciplinary measures will be taken while the criminal case is ongoing.

Renewed debate over public officials’ online conduct

The case has renewed discussions across Britain about the responsibilities of elected officials when using social media platforms.

Political observers say public representatives are increasingly being held accountable for historic online posts, particularly where comments are considered discriminatory or offensive.

The prosecution also highlights the growing willingness of law enforcement authorities to investigate and, where appropriate, bring criminal charges over social media content that may breach UK communications laws.

As the case proceeds through the courts, attention will focus on the legal arguments presented and the eventual ruling.

For now, Glenn Gibbins remains due to appear before South Tyneside Magistrates’ Court on August 21, 2026, where the charge against him will be formally considered.
