A Swiss mother and her husband have been freed after spending 599 days in custody following convictions linked to allegations of physical and sexual abuse made by the woman’s teenage daughter.

The case has sparked fresh questions about the justice system after the daughter, who is now 19, reportedly admitted that she fabricated the allegations when she was 14.

According to reports citing Swiss newspaper Tages-Anzeiger, the woman contacted the Zurich High Court years after making the allegations and withdrew her claims. The court has since overturned the convictions of her mother and stepfather.

Teenager admitted she had fabricated allegations

The girl originally accused her mother and stepfather of repeatedly abusing her.

Her allegations included claims of physical violence and sexual abuse by her stepfather. She reportedly told authorities that she had been beaten and subjected to various forms of punishment inside the family home.

The seriousness of the accusations led authorities to intervene, with the teenager and her younger siblings eventually placed in foster care.

However, years later, the woman changed her account.

In her confession, she reportedly said she had lied because she “only wanted her freedom” and claimed that she had never intended for the allegations to result in a police investigation.

Court initially considered her claims highly credible

One of the most striking aspects of the case is that the teenager’s original allegations were considered credible by the courts.

A four-member expert team reportedly assessed her statements as having a high probability of credibility.

The Zurich District Court subsequently convicted the stepfather in July 2021 and sentenced him to three years in prison. The mother received a 22-month sentence for her role in the case.

Reports also indicate that teachers had previously told the court that the teenager was known to lie regularly and had spoken about hearing voices.

Those details have since attracted renewed scrutiny because they were reportedly not given sufficient weight when authorities assessed her accusations.

Sentences became harsher after appeal

The legal battle did not end with the initial convictions.

Following an appeal, the Zurich High Court, in Swiss handed down significantly longer sentences in 2023.

The stepfather was sentenced to 50 months in prison for aggravated assault and multiple counts relating to child sexual abuse, while the mother received a 47-month sentence for aiding and abetting. Court records confirm that 599 days of detention had already been served.

The couple continued to maintain their innocence.

The case eventually took another dramatic turn when the daughter, now an adult, withdrew the allegations and admitted that she had invented the story.

High Court overturns convictions

Following the confession, the Zurich High Court, in Swiss overturned the convictions against the mother and stepfather.

Reports say an initial investigation into the confession confirmed its authenticity and found no evidence that the young woman had been pressured into retracting her accusations.

The development effectively transformed the case from one involving alleged abuse within a family into a major legal controversy involving a false accusation and the consequences that followed.

The mother and stepfather had each spent 599 days in detention before the latest development.

Daughter now faces criminal investigation

The teenager’s confession has also resulted in legal consequences for her.

Zurich’s juvenile prosecutor’s office has opened an investigation into the young woman over allegations including false accusation, misleading the administration of justice and unlawful deprivation of liberty.

The investigation is expected to examine how the original allegations were made, what motivated them and how they ultimately resulted in the couple’s prolonged detention and convictions.

At this stage, the investigation against the young woman remains ongoing, and she has not been convicted of the alleged offences.

Questions over the justice system

The case has raised difficult questions about how authorities assess allegations made by children and teenagers, particularly when those allegations involve serious abuse.

The original claims were detailed enough to convince experts and courts that they were credible. Yet the later confession has shown that the account was false, according to the reports.

That has prompted scrutiny of the evidence-gathering process, expert assessments and the decisions that resulted in two adults spending more than a year and a half behind bars.

The case also demonstrates the potentially devastating consequences of false allegations, while highlighting the need for genuine abuse claims to be investigated carefully and fairly.

A dramatic reversal after years of legal consequences

For the Swiss couple, the reversal comes after years of legal consequences stemming from allegations they denied.

Their convictions have now been overturned, while the woman who made the allegations is facing her own investigation.

The case is likely to continue attracting attention as authorities examine the circumstances surrounding the confession and the original investigation.

It also leaves difficult questions about how the justice system can distinguish between genuine disclosures of abuse and deliberately fabricated allegations without discouraging victims of real abuse from coming forward.

For now, the most significant development is clear: the Zurich High Court, Swiss has overturned the convictions of the mother and stepfather after the daughter admitted that she had fabricated the allegations.
