In a shocking federal civil rights settlement, five Black children who were subjected to slave-like conditions and forced labor by their wealthy, white adoptive parents have been awarded a maximum $4.4 million payout from the state of West Virginia. Kanawha County Circuit Judge Maryclaire Akers approved the maximum allowable payout following a lawsuit revealing that state Child Protective Services (CPS) repeatedly failed to rescue the young siblings.

The monumental financial settlement marks an important step toward securing long-term care, therapy, and educational support for the young victims following years of systemic neglect and severe racial abuse.

1. The Shocking $4.4M West Virginia State Settlement

The landmark legal ruling ensures that the five Black children, who range in age from 6 to 16, will receive the maximum monetary compensation available under West Virginia state law. Attorney Dante diTrapano, representing the young siblings, confirmed that the payout will be divided among the survivors to cover ongoing medical treatment and post-traumatic stress disorder (PTSD) therapy.

Reflecting on the court’s approval, diTrapano noted that the funds will finally grant the Black children an opportunity to regain their youth after being robbed of their innocence by their former guardians.

2. Adoptive Parents Sentenced to 375 Years in Prison

The criminal case against the adoptive parents, Jeanne Kay Whitefeather and Donald Lantz, culminated in combined prison sentences totaling 375 years. Prosecutors demonstrated that the couple targeted the Black children specifically because of their race, forcing them to perform arduous physical labor on their Sissonville property.

Law enforcement officials characterized the parents’ actions as modern-day slavery, highlighting that the couple exploited the vulnerable status of the Black children while ignoring basic human rights standards.

3. Severe Living Conditions and Forced Farm Labor

Police discovered the harrowing reality endured by the Black children after concerned neighbors alerted authorities about teenagers trapped inside an outbuilding. Responding officers found two of the eldest siblings—a 14-year-old boy and a 16-year-old girl—locked inside a small shed with no electricity, running water, or lighting.

The traumatized Black children revealed to investigators that they were forced to sleep on bare concrete floors, perform 12-hour shifts as farmhands, and use a portable RV toilet without access to proper sanitation or adequate food.

4. CPS Neglect and Failures in Child Welfare

The lawsuit filed on behalf of the Black children detailed severe administrative lapses within West Virginia’s Department of Human Services. Despite receiving dozens of distress calls from neighbors reporting abuse, social workers failed to conduct proper wellness checks, with one worker merely leaving a business card at the front door.

When social workers did briefly speak to the Black children, they conducted interviews within direct earshot of the abusive parents. State officials have since fired at least one employee involved, while lawmakers face mounting pressure to overhaul West Virginia’s child welfare system.

5. Legal Action Expanding to Washington State

Following the successful resolution in West Virginia, legal representation for the Black children announced plans to pursue additional legal action against Washington state’s Human Services Department. The legal team alleges that Washington state officials acted negligently by approving the family’s relocation to West Virginia despite prior reports of child mistreatment on file.

Meanwhile, the Black children have been placed in safe, loving adoptive homes where they are receiving comprehensive psychological support, care, and the freedom to experience a normal childhood.
